WeddingRecaps Terms of Service (DRAFT)
DRAFT for attorney review. Not legal advice. Prepared 2026-10-18 for WeddingRecaps (operated by Lipa Honig as an individual, doing business as WeddingRecaps; no LLC is formed). Placeholders are in [brackets]. Items marked DECISION need Lipa or the CEO. No mailing address is included on purpose; a business contact address gets added by counsel if required (an assumed-name/DBA filing may also be needed in New York).
Effective date: [date]
1. Agreement
These Terms are between you and Lipa Honig, doing business as WeddingRecaps ("WeddingRecaps", "we"). They cover couples (who book a wedding) and guests (who upload through a wedding's link or QR code). By using the service you agree to these Terms and to the Privacy Policy.
2. The service
- We give each wedding a private upload page and QR code. Guests upload photos and videos. Guests can only upload; they can't view, browse or search media.
- Couples get a private, signed-in gallery of their wedding's uploads, with search by guest name, depending on the package.
- Delivery targets: guest reels within 48 hours of the wedding (or of the upload window closing, DECISION), and couple reels and films within 3–7 days. These are good-faith targets, not guarantees. A reel depends on what guests actually upload.
- Packages and prices are as shown at checkout.
3. Couples' responsibilities
- You must be 18 or older and able to make a contract.
- You'll share the link and QR code only with your guests, and tell them how uploads are used (we provide a consent screen on the upload page).
- You're responsible for having permission to film at your venue, and for the people (including children) appearing in your footage, as between you and us.
- You won't download and redistribute guests' media in ways your guests didn't agree to. DECISION: how far the couple's use of media may go (personal use vs. commercial).
4. Guests' uploads and license
- You keep ownership of what you upload.
- When you upload, you give the couple a non-exclusive, perpetual, royalty-free license to keep, copy, edit and share your uploads for personal and non-commercial purposes connected to the wedding.
- You give WeddingRecaps a non-exclusive, worldwide, royalty-free license to host, copy, edit, transcode, combine with music and other footage, and deliver your uploads, solely to provide the service to the couple and to you. Our license ends when the content is deleted under our retention schedule, except for copies in backups pending purge.
- We won't use guest uploads in our own advertising without separate written permission. DECISION/counsel.
- You confirm you have the right to upload the content, and that it doesn't violate anyone's rights or the law.
5. Acceptable use
No illegal content, sexual content, harassment, malware, content you don't have rights to, or attempts to access other weddings or bypass limits. We may remove content or disable a wedding's link to protect the service, guests or couples.
6. Music and third-party content
Reels may include licensed music and assets. You may share reels on personal social media, but platforms may mute or claim audio under their own rules. You may not separate the music from a reel or use it commercially. DECISION: confirm the music license and its wording (see launch/03-music-license.md).
7. Payment, refunds and cancellations
One-time fees per wedding, charged in full at booking. DECISION: refund and cancellation policy (e.g. a full refund up to [X] days before the wedding; no refund after the upload window opens; a partial refund if we miss delivery).
8. Retention and deletion
Raw uploads are deleted 90 days after the wedding (DECISION). Reels and films are kept for [12 months] (DECISION). Download anything you want to keep before then; we'll send a reminder. Deletion requests are handled as described in the Privacy Policy.
9. Disclaimers
The service is provided "as is" and "as available". We don't guarantee that every moment is captured, that every guest uploads, or that we'll deliver a reel for footage that's unusable (too short, too dark, or in a broken format).
10. Limitation of liability
To the extent the law allows, our total liability for any claim is limited to the fees you paid for the affected wedding (or $[100] for guests). We aren't liable for indirect or consequential damages. Counsel to review for enforceability under New York law.
11. Indemnity
You agree to cover our losses from content you upload or from your breach of these Terms, to the extent the law allows.
12. Governing law and disputes
New York law governs, and the state or federal courts in [county], New York have jurisdiction. DECISION/counsel: arbitration and a class-action waiver, or courts; small-claims carve-out.
13. Changes and contact
We may update these Terms and will post the new date. Contact: hello@weddingrecaps.com (planned).
