Guest upload consent (DRAFT)

DRAFT for attorney review. Not legal advice. Prepared 2026-10-18 for WeddingRecaps (operated by Lipa Honig as an individual, doing business as WeddingRecaps; no LLC is formed). Placeholders are in [brackets]. Items marked DECISION need Lipa or the CEO. No mailing address is included on purpose; a business contact address gets added by counsel if required (an assumed-name/DBA filing may also be needed in New York).

The box is required: the browser and the server both reject uploads without it. The server stores consent_at and the text version on each upload. Whenever this text changes, bump CONSENT_TEXT_VERSION.

DECISION: minimum age (18+, or 13+ with a parent's permission, per legal-setup.md).

Contact details are stored separately for each wedding. They are never shown to other guests, never sent back to your browser after you submit, and not shown to the couple (DECISION: confirm). We don't sell them. If you opt out of marketing, we apply that to every wedding where you used the same email or number.

B. Full guest consent (linked from the checkbox)

Sharing your photos and videos with [Couple names] through WeddingRecaps

  1. What happens to your uploads. Your photos and videos go privately to [Couple names]'s wedding on WeddingRecaps. Only the couple can see the uploads, in a private gallery where they can also search by the name you enter. Other guests can't see them, and neither can you after uploading. Nothing is posted publicly by us.
  2. What you allow.
  3. (a) The couple may keep, download, edit and share your uploads for personal, non-commercial purposes related to their wedding.
  4. (b) WeddingRecaps may store, edit, combine with music and other guests' footage, and deliver your uploads to make reels for the couple and for you.
  5. We won't use your uploads in WeddingRecaps advertising without asking you separately.
  6. Your reel (email and phone required). We'll send a link to your personal reel by email and/or text, usually within 48 hours after the wedding, plus messages about that reel. No marketing emails or texts unless you tick the separate opt-in boxes. Your contact details aren't shown to the couple or other guests. DECISION: confirm. Optional extras (mailing address, X and Instagram handles) are used only as described in the table above. Unsubscribing from marketing never stops your reel from being delivered.
  7. Your name (optional). If you enter a name, the couple sees it with your uploads and can search by it.
  8. People in your footage. Please only upload content you have the right to share. Be thoughtful about children and anyone who asked not to be filmed. Uploads may include location data from your phone (DECISION: whether we strip it).
  9. How long we keep it. Raw uploads are deleted 90 days after the wedding (DECISION). Edited reels are kept for [12 months] (DECISION; DECISION (Lipa) — P8: this ends around the first anniversary; extend to [13 months] or warn the couple [30] days before deletion. Unchanged until decided). The couple may keep copies they download.
  10. Changing your mind or deleting. Email hello@weddingrecaps.com with the couple's names, the wedding date and roughly when you uploaded, and we'll delete your uploads and contact details (email, phone, name, address, handles) within [30] days. Reply STOP (or QUIT, END, CANCEL, UNSUBSCRIBE, OPT OUT or REVOKE) to any text to stop all automated texts, including reel-ready texts (we'll still email your reel); use the unsubscribe link to stop marketing emails. Reels already made and downloaded by the couple may not be recallable; we'll stop using your footage in new edits. DECISION/counsel.
  11. No face recognition. We don't use facial recognition on your uploads. (If that ever changes, we'll ask for separate, explicit consent first.)
  12. Age. You confirm you're [18 or older, or have a parent's or guardian's permission] (DECISION).
  13. SMS terms. Marketing texts only with the SMS box ticked; recurring and automated; not a condition of uploading or purchase; msg & data rates may apply; frequency varies; reply STOP (or QUIT, END, CANCEL, UNSUBSCRIBE, OPT OUT or REVOKE) to stop all automated texts to that number, including reel-ready texts (your reel still comes by email); reply HELP for our name, contact email and how to opt out. No texts are sent until carrier (10DLC) registration is done.
